SmartSeas AI (“the Company”) is committed to providing a work environment that ensures every employee is treated with dignity and respect and free from any form of harassment, including sexual harassment. This policy aims to prevent, prohibit, and redress sexual harassment at the workplace in accordance with the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 (“POSH Act”).
This policy applies to:
All employees of SmartSeas AI (permanent, temporary, interns, consultants, trainees, or contractual staff).
All work-related settings including the office premises, client sites, virtual meetings, work travel, company events, and any location connected to work activities.
All genders, recognizing the right to protection against sexual harassment.
Sexual harassment includes any one or more of the following unwelcome acts or behavior (whether directly or by implication):
Physical contact or advances.
Demand or request for sexual favors.
Making sexually colored remarks.
Showing pornography or sexually explicit material.
Any other unwelcome physical, verbal, or non-verbal conduct of sexual nature.
Examples include:
Inappropriate comments on appearance or clothing.
Repeated unwelcome social invitations or messages.
Sexually suggestive jokes or gestures.
Displaying offensive materials.
Threats or retaliation for rejecting advances.
SmartSeas AI shall constitute an Internal Committee (IC) as mandated by the POSH Act.
Composition:
Presiding Officer: A senior woman employee of the organization.
Two Employee Members: Employees committed to the cause of women or with experience in social work/legal knowledge.
Tenure: Three years from the date of nomination.
Responsibilities:
Receive and investigate complaints of sexual harassment.
Recommend corrective actions and preventive measures.
Maintain confidentiality and fairness during proceedings.
Prepare and submit annual reports to the management and local authorities.
Operational data is retained for the duration of your organization’s active subscription, while personal data is kept only for as long as necessary to fulfill the purposes described in this policy. Users also have the option to request data deletion at any time through their administrator or by reaching out to our support team.
a. Lodging a Complaint
Any aggrieved person may file a written complaint within 3 months of the incident.
Complaints should be sent to the Internal Committee via email or in writing, addressed to the Presiding Officer.
If the aggrieved person is unable to file personally, a legal heir or colleague may file on their behalf.
b. Assistance
The IC shall assist the complainant in drafting the complaint if required.
Depending on applicable laws, you may have certain rights regarding your personal data. These include the ability to access, correct, or delete your personal information, request a copy of your data in a portable format, restrict or object to the processing of your data, and withdraw consent where processing is based on consent. To exercise any of these rights, you can send a request to privacy@smartseas.ai
The IC shall begin the inquiry within 7 days of receiving the complaint.
Both parties shall be given a fair opportunity to present their case.
The inquiry shall be completed within 90 days.
The IC shall submit its findings and recommendations to the management within 10 days of completion.
Management shall act on the recommendations within 60 days.
Written apology.
Warning or reprimand.
Suspension, demotion, or termination.
Mandatory counseling or awareness training.
Deduction from salary as compensation to the complainant.
All proceedings, complaints, and recommendations of the IC shall be strictly confidential. Disclosure of information to any unauthorized person shall invite disciplinary action.
If the IC concludes that the complaint was malicious or made with false intent, disciplinary action may be taken against the complainant. However, inability to substantiate a complaint will not be considered malicious intent.
Regular training sessions and awareness programs will be conducted.
POSH policy shall be displayed at prominent locations and shared during onboarding.
Periodic audits will be conducted to ensure compliance and employee safety.
No person shall be victimized or discriminated against for filing a complaint or assisting in an investigation. Any form of retaliation will result in disciplinary action.
